
News - This story has tickled me more than most this week -
A Houston lawyer says Texas has made a "massive mistake" in its 2005 Constitutional amendment to ban gay marriage and now everyone in the state is divorced. Just think of all that 'living in sin' they're going to have to repent for!
The amendment, approved by the Legislature and overwhelmingly ratified by voters, declares that "marriage in this state shall consist only of the union of one man and one woman." Which is all good and homophobic, except that it goes on to say -
"This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage."
And this, according to Democratic candidate for attorney general, Barbara Ann Radnofsky, is responsible for forcing divorce upon the populace.
"It's a silly argument," said Kelly Shackelford, president of the Liberty Legal Institute in Plano. Any lawsuit based on the wording of Subsection B, he said, would have "about one chance in a trillion" of being successful.
Which is unfortunately true - not that I'm wishing broken homes upon the lonestar state - however it does point out how ridiculous it is to legislate AGAINST the wishes of ANYONE wishing to get married/civil partnered. If people were truly equal, and the law was there to protect us then either we could all get married, or none, as this obtuse piece of wording illustrates.
It's an interesting political tactic to try and teach people about gay rights, by subjecting non-gays to our very conditions, rather than just saying - 'we want what you've got'. But do you think any of the outraged heterosexual couples who almost glimpsed their rights torn away from them will consider this?
